Terms of Service & Operating Philosophy

Welcome to SPLASHYSTUDIOS LLC.

This document serves two purposes:

  • the legal terms governing use of our platforms and services
  • a clear statement of how and why these products exist

By accessing or using any SPLASHYSTUDIOS LLC product, website, or service — including but not limited to The Splash Club, SplashyPages, and related domains — you agree to these terms.

1. What This Is

SPLASHYSTUDIOS LLC is an independent software and services company.

We build and operate two primary products:

The Splash Club is a local SEO agency for small service businesses. We offer focused engagement services — including the Local SEO Sprint — that help local businesses rank on page one of Google, show up in the map pack, and generate consistent inbound leads.

SplashyPages is a complete business website platform for local service businesses and independent software founders. It includes an SEO-optimized website builder, lead capture and management, AI-powered chatbot, blog and article publishing, local SEO citation tools, analytics, and team management — all in one dashboard.

All products and services are governed by these terms.

2. Accounts & Identity

  • Use one account and use it honestly. You may choose your name, brand, or project identity as long as it is not misleading, impersonating, or abusive.

  • No manipulation. Multiple accounts used to game visibility, rankings, traffic, or system behavior are not allowed.

  • No automation. Accounts must be operated by a human. Bots, scripts, or automated usage are prohibited unless explicitly authorized.

You are responsible for all activity that occurs under your account.

3. Content Ownership & Licensing

  • You own your content. SPLASHYSTUDIOS LLC does not claim ownership of content you create or publish on SplashyPages.

  • License to operate the service. By publishing content or business information, you grant SPLASHYSTUDIOS LLC a non-exclusive, worldwide license to host, display, process, and distribute that content solely for operating, maintaining, and promoting the service.

  • When you leave, your content leaves with you. Upon account cancellation or deletion, your published SplashyPages website will be taken offline. Your content is yours — we don't retain or republish it after the relationship ends.

Publish intentionally.

4. SplashyPages Platform

SplashyPages is a complete website and lead generation platform. It allows users to:

  • build SEO-optimized websites with service pages, location landing pages, gallery, testimonials, and FAQs
  • capture and manage leads from contact forms and AI chatbot interactions in a centralized dashboard
  • publish keyword-targeted blog and article content to drive organic search traffic
  • deploy an AI-powered chatbot trained on their business to answer visitor questions and capture leads 24/7
  • build local SEO authority through citation management and Google Business Profile optimization
  • track website performance and lead analytics from a single dashboard
  • manage teams and connect a custom domain

You are responsible for the accuracy, legality, and appropriateness of all business information, content, and communications on your SplashyPages website.

You agree not to:

  • publish false or misleading business claims
  • impersonate another business or individual
  • use SplashyPages for spam, scams, or deceptive lead generation
  • attempt to manipulate search engines, ad systems, or traffic sources in ways that violate applicable terms or laws
  • use the platform to collect or process personal data in violation of applicable privacy law

5. AI-Assisted Features

SplashyPages includes AI-powered functionality, including an on-site business chatbot (available on Business and Enterprise plans) and AI-assisted content generation tools.

You acknowledge that:

  • AI responses are generated based on the information you provide about your business
  • AI output may be imperfect or incomplete
  • AI features are intended to assist, not replace, human judgment
  • You are responsible for reviewing and maintaining the accuracy of AI-generated content on your website

You agree not to use AI features to generate:

  • deceptive, abusive, or illegal content
  • impersonation or misrepresentation
  • content intended to bypass moderation or safety systems

We reserve the right to limit, modify, or suspend AI functionality to maintain platform quality and safety.

6. The Splash Club Agency Services

The Splash Club offers professional SEO services, including the Local SEO Sprint. These are service engagements governed by the following terms.

Results are not guaranteed. We work to deliver measurable improvements in local search visibility and inbound lead generation. However, search engine rankings and lead volume are influenced by factors outside our control, including competitor activity, algorithm changes, and market conditions. We do not guarantee specific ranking positions or lead volumes.

Engagement scope. The scope of work for any agency engagement is defined at the time of purchase. You are responsible for providing accurate, complete, and timely information needed to complete the engagement.

Content and access. In some cases, completing SEO work requires access to your website, Google Business Profile, or other digital properties. You agree to grant necessary access in a timely manner. Delays caused by lack of access may affect delivery timelines.

Ownership of deliverables. Upon completion of an engagement and receipt of full payment, ownership of all deliverables produced by The Splash Club passes to you.

7. Acceptable Use

You agree not to use the Service in ways that include:

  • hate speech, threats, or targeted harassment
  • impersonation or deceptive identity use
  • illegal, pornographic, or exploitative material
  • malicious links, malware, or phishing
  • behavior intended solely to disrupt or abuse the platform

We reserve the right to act when behavior undermines the purpose or integrity of the service.

8. Membership, Trials & Paid Plans

SplashyPages is offered under four subscription tiers: Starter, Pro, Business, and Enterprise. Plans are billed monthly or annually. Annual billing is offered at a discount.

  • A 7-day free trial is available on all plans. No credit card is required to start a trial.
  • Trial accounts have access to platform features during the trial period. After expiration, continued access requires a paid subscription.
  • Paid plans are clearly disclosed at purchase and may be upgraded, downgraded, or cancelled at any time.
  • Payments are non-refundable except where required by law.

The Splash Club agency engagements are priced individually based on engagement scope and are paid in accordance with the terms agreed at the time of purchase.

You must be at least 18 years old to create an account, purchase a subscription, or engage The Splash Club for services. By using the Service, you represent that you meet this requirement.

9. Privacy & Data

  • We collect only what is necessary to operate the service (account data, content, usage data, basic analytics).
  • We do not sell user data.
  • We do not operate third-party behavioral advertising on user content.

10. Platform Availability

All SPLASHYSTUDIOS LLC products are provided as-is.

We make no guarantees regarding:

  • uptime
  • availability
  • uninterrupted service
  • data permanence beyond reasonable operational effort

Features, pricing, and availability may change at any time.

11. Enforcement & Termination

We may:

  • issue warnings
  • restrict features
  • remove content
  • suspend or terminate accounts

Enforcement decisions are based on behavior and impact, not ideology, popularity, or viewpoint.

12. Updates to These Terms

These terms may be updated as products evolve.

Continued use of the service constitutes acceptance of the current version.

13. Operating Philosophy

We believe:

  • tools should do a clear job
  • good SEO is honest SEO — it earns rankings through quality, not manipulation
  • lead generation should help real businesses connect with real customers
  • automation should support people, not replace accountability
  • purpose-built software produces better outcomes than all-in-one noise
